Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Confidently platform, website, and all related services (collectively, the "Service") operated by Confidently ("we," "our," or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

• You must be at least 16 years of age to use the Service.
• You must provide accurate, complete, and current information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.

Confidently is an AI-powered career preparation platform that provides:

• AI Mock Interviews: Simulated interview practice with AI-generated questions, scoring, and personalized feedback across technical, behavioral, and HR interview formats.
• Communication Coach: AI-assisted English communication practice including grammar correction, vocabulary building, and speaking confidence tracking.
• Resume Analyzer: Automated ATS compatibility analysis, keyword matching, quality scoring, and AI-generated improvement suggestions for uploaded resumes.
• Resume Builder: A multi-section resume editor with AI-powered content optimization and PDF/DOCX export.
• Job Autopilot: Job discovery, matching, and application tracking features. Note: Job listings may include mock/demo data. Confidently does not submit job applications on your behalf unless an explicit external integration is active.
• Dashboard & Analytics: Progress tracking, confidence scoring, XP/level system, and career readiness metrics.

• You may create one account per person. Duplicate or shared accounts may be suspended.
• Authentication is managed through Clerk. By using the Service, you also agree to Clerk's terms of service and privacy policy.
• You must notify us immediately if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload malicious files, viruses, or harmful content through the resume upload or any other feature.
• Attempt to reverse-engineer, decompile, or extract source code from the Service.
• Scrape, crawl, or use automated tools to extract data from the Service without written permission.
• Impersonate another person or misrepresent your identity or affiliation.
• Use the Service to generate fraudulent resumes, fake credentials, or misleading professional information.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Attempt to bypass rate limits, security controls, or access restrictions.
• Use AI-generated content from the Service in a way that violates the intellectual property rights of others.

• Nature of AI Output: The Service uses AI models (including Google Gemini) to generate interview questions, feedback, resume analysis, and improvement suggestions. AI-generated content is provided for educational and preparatory purposes only.
• No Guarantee of Accuracy: AI output may contain errors, inaccuracies, or biases. You are responsible for reviewing and validating any AI-generated content before relying on it.
• Not Professional Advice: AI feedback does not constitute professional career counseling, legal advice, or employment advice. Consult qualified professionals for specific career decisions.
• Ownership: You retain ownership of your original content (resumes, answers, profiles). AI-generated suggestions and feedback are licensed to you for personal, non-commercial use.

• Free Plan: The Service offers a free tier with limited features. No payment is required for the free plan.
• Paid Plans: Premium features are available through paid subscription plans (Pro, Autopilot). Pricing is displayed on the Pricing page.
• Billing: Paid subscriptions are billed on a recurring monthly or yearly basis depending on the plan selected.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Price Changes: We reserve the right to modify pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect.
• Payment Processing: Payment processing is handled by our third-party payment provider. We do not store your full credit card information on our servers.

• Our Content: The Service, including its design, code, AI models, branding, logos, text, and visual assets, is owned by Confidently and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.
• Your Content: You retain ownership of all content you upload or create on the platform (resumes, interview answers, profile data). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the Service.
• Feedback: If you provide feedback, suggestions, or feature requests, you grant us a perpetual, royalty-free license to use that feedback to improve the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you agree to the terms of the Privacy Policy.

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
• We do not guarantee that using the Service will result in a job offer, interview success, or career advancement.
• Mock interview scores, ATS scores, and confidence metrics are AI-generated estimates and should not be treated as definitive assessments.
• Job listings displayed on the platform may be mock/demo data unless explicitly connected to a live job-board API.

To the maximum extent permitted by applicable law, Confidently and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, employment opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or ₹500, whichever is greater.

You agree to indemnify and hold Confidently harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

• You may terminate your account at any time by contacting us or using the Data & Account section in your dashboard settings.
• We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if required by law.
• Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, India.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
